What Is The Wakaya Perfection Lawsuit about?

Wakaya Perfection filed a lawsuit against Youngevity, and this was reportedly done with the effort to “address Youngevity’s breaches of contract, as well as the individual defendants’ independently tortious behavior.”

With this, Blake Graham, Andre Vaugh, Dave Pitcock, and Barb Pitcock all claimed that “without justification, Youngevity terminated [their] distributorships. As a result, businesses have been damaged and their livelihoods threatened.”

The lawsuit in question has been ongoing since that original filing that took place in April of last year (2016), but Youngevity recently took a stand to dismiss the lawsuit by voting an arbitration clause.

A decision was made with this motion from Youngevity on November 7, 2017, and citing the arbitration clause from Youngevity, it’s stated that the clause “requires all Distributor Plaintiffs’ claims to be decided by arbitration in San Diego, California, before the American Arbitration Association.”

Additionally, within Youngevity’s official motion to dismiss the lawsuit that Wakaya Perfection has against it, it’s stated that any claims made by Wakaya Perfection or its affiliates are “subject to a binding arbitration clause in Youngevity’s Policies and Procedures.”

Judge Nuffer chose to uphold Youngevity’s dismissal of the lawsuit, and along with this, said that any disputes are to be handled through the means of arbitration.

However, as you’d probably expect, Wakaya Perfection wasn’t too thrilled with this decision. The company obviously doesn’t want to settle this matter through arbitration, and as such, the company has chosen to filed a Note of Appeal.

This was filed on November 9, and while it makes sense as to why Judge Nuffer made the decision that he did, it certainly is an odd development in this ongoing story.

I can’t imagine that Wakaya Perfection will take this move laying down, so we’ll have to wait and see what happens from here.
